# TACIT Terms of Service

## 1. Agreement to Terms

TACIT („TACIT,” „we,” „our,” or „us”) provides a mobile application that curates AI-related news and educational video courses (the „Service”). By downloading, accessing, or using the Service, you agree to be bound by these Terms of Service (the „Terms”). If you do not agree with these Terms, you may not use the Service.

## 2. Eligibility

You must be at least 13 years of age to use TACIT. If you are between 13 and 18 (or the age of majority in your jurisdiction), you may use TACIT only with the consent and supervision of a parent or legal guardian who accepts these Terms on your behalf. By using the Service, you represent and warrant that (a) you meet the eligibility requirements, and (b) you will comply with all applicable laws and regulations.

## 3. Account Registration and Security

– To access certain features, you must create an account using Google Sign-In or Sign in with Apple. You agree to provide accurate information and to keep it up to date.

– You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

– Notify us immediately at info@tacitproject.hu if you suspect unauthorized access or any breach of security.

– We reserve the right to suspend or terminate accounts that violate these Terms or are otherwise deemed at risk.

## 4. License and Ownership

– TACIT grants you a limited, revocable, non-transferable license to install and use the Service on Apple-branded devices you own or control, solely for personal, non-commercial use.

– All content provided through TACIT, including text, video, images, graphics, logos, and software, is owned by TACIT or our licensors and is protected by intellectual property laws. Except for the limited license above, no rights are transferred to you.

– You may not copy, distribute, modify, host, sell, or exploit any portion of the Service without our prior written consent.

## 5. Purchases, Subscriptions, and Refunds

– TACIT offers paid courses and subscription plans processed via Apple’s in-app purchase system. Additional purchases may be managed through our web backend.

– You agree to comply with Apple’s App Store terms, payment policies, and applicable taxes when making in-app purchases. Purchases made on the web are subject to the terms presented at checkout.

– Access to purchased courses and subscription entitlements is tied to your TACIT account. You are responsible for keeping your account in good standing to retain access.

– Except where required by law, all sales are final. Refund requests must be directed to Apple for App Store purchases or to TACIT support for web-based transactions.

– We may change pricing, features, or availability of courses and subscriptions with advance notice where required. Continuing to use the Service after such changes constitutes acceptance.

## 6. Acceptable Use

You agree not to:

– Reverse engineer, decompile, or attempt to discover the source code or underlying ideas of the Service.

– Access or use the Service for unlawful, harmful, fraudulent, infringing, or abusive purposes.

– Upload or transmit viruses, malware, or any code that may interrupt, damage, or limit the functionality of the Service.

– Circumvent, disable, or interfere with security-related features, purchase validation, or content protections.

– Use automated systems (e.g., bots, scrapers) to access TACIT without prior written authorization.

## 7. User Feedback and Suggestions

You may voluntarily submit feedback, ideas, or suggestions. By providing feedback, you grant TACIT an unrestricted, royalty-free, perpetual license to use and incorporate it without obligation to you.

## 8. Third-Party Services

The Service may integrate or link to third-party services such as Google Sign-In, Apple, Firebase, Vimeo, and payment processors. Your use of those services is governed by their respective terms and privacy policies. TACIT is not responsible for third-party content or practices.

## 9. Content and Educational Disclaimer

The articles, videos, and other materials available in TACIT are for informational and educational purposes only. They do not constitute financial, legal, investment, or professional advice. You should not rely on TACIT as the sole basis for making decisions.

## 10. Availability and Modifications

– We strive to keep TACIT available and up to date, but we do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, outages, or unforeseen issues.

– We may add, modify, or remove features at any time. We will provide notice when material changes affect your access to paid content or subscriptions.

## 11. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, if you violate these Terms or if we reasonably believe your use poses a risk to TACIT or other users. You may stop using the Service and delete your account at any time via the in-app settings or by contacting us. Upon termination, the rights granted to you will cease.

## 12. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN „AS IS” AND „AS AVAILABLE” BASIS. TACIT AND ITS LICENSORS DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, SECURE, OR UNINTERRUPTED, OR THAT RESULTS OBTAINED FROM ITS USE WILL BE ACCURATE OR RELIABLE.

## 13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TACIT, ITS AFFILIATES, DIRECTORS, EMPLOYEES, LICENSORS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF THE SERVICE; (B) ANY CONDUCT OR CONTENT OF OTHER USERS OR THIRD PARTIES; OR (C) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR ACCOUNT OR CONTENT. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US, IF ANY, DURING THE SIX (6) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE CLAIM.

## 14. Indemnification

You agree to indemnify, defend, and hold harmless TACIT and its affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with (a) your access to or use of the Service, (b) your violation of these Terms, or (c) your violation of any third-party right, including intellectual property or privacy rights.

## 15. Governing Law; Dispute Resolution

These Terms are governed by the laws of the State of California, USA, without regard to its conflict of laws principles. Any dispute arising under or related to the Service shall be resolved exclusively in the state or federal courts located in San Francisco County, California, and you consent to the jurisdiction of such courts. If you reside outside the United States, nothing in this section limits your consumer protections under mandatory laws of your own jurisdiction.

## 16. Changes to These Terms

We may update these Terms to reflect new functionality, regulatory requirements, or other changes. If we make material changes, we will provide reasonable notice (for example, via the app or by email). Continued use of TACIT after the updated Terms take effect constitutes acceptance.
